Ex-OC SHERIFF MIKE CORONA HEADING TO PRISON AFTER LOSING FEDERAL COURT APPEAL. HAS HE RUN OUT OF "GET OUT OF JAIL FREE CARDS?"

The OC

Well, looks like ex-Orange County Sheriff Mike Carona has run out of "Get out Of Jail Free Cards."  Yep, after a couple of years of court appeals, ole' Sheriff Mike is heading to Prison.

Today the 9th U.S. Circuit Court of Appeals ruled that U.S. District Judge Andrew Guilford did not abuse his discretion when he declined to grant a defense motion by Carona and his defense team to "suppress evidence based on alleged misconduct."

If you remember, Carona served as Sheriff of Orange County, an elected position, from January 1999 until early 2008, when he resigned following his indictment on various charges including lying to a Grand Jury (yep, can't do that) and witness tampering (nope, can't do that either Mike).

Carona was given a 5½ year term in the Club Fed in April 2009.

Detailed in the  20-plus page ruling today are some of the following points:

During his initial campaign for sheriff in 1998, Carona received financial support from Donald Haidl. Haidl testified at trial that Carona “offered [him] the complete power of the sheriff’s department for raising money and supporting him.”

After Carona took office, Haidl testified that he continued to make payments to Carona. He became concerned that Carona was jeopardizing his position and Haidl’s arrangement by accepting small amounts from other people. Haidl testified that he offered Carona and Assistant Sheriff George Jamarillo each a “bribe not to take bribes” in the amount of $1000 per month, which they accepted. Haidl also testified that he gave Carona a speedboat in 2001, which they concealed through a sham transaction.

In 2004, the federal government began an investigation. In early 2007, Haidl admitted his own criminal misconduct and signed a cooperation plea agreement with the government.

Following this plea agreement, government attorneys instructed Haidl to meet with Carona and to make surreptitious recordings of their meetings. At this time, Carona was represented by attorney Dean Stewart, who had notified the government that he was representing Carona.

Haidl met with Carona on July 7, 2007, and July 15, 2007, but these meetings did not provide enough evidence to satisfy the prosecutors. In preparation for a subsequent meeting, the government equipped Haidl with two fake “subpoena attachments” that identified certain records that Haidl was to tell Carona he had been subpoenaed to produce. These documents referred to cash payments Haidl provided to Carona and to the sham transaction they used to conceal the gift of the speedboat.

Haidl and Carona met again on August 13, 2007, and in their conversation, Carona made statements that suggested both that he had received payments and gifts from Haidl and that he wanted Haidl to lie to the grand jury about these transactions.

Ruling From Court:

The Court issued the final conclusion in the case today:

"It does not appear to us that there was a violation of Rule 2-100 by the prosecutors in this case, but even if there had been, the district court’s decision to deny Carona’s motion to suppress and other requested relief was not an abuse of discretion. Carona’s conduct violated 18 U.S.C. § 1512(b)(2)(A), and consequently the district court properly denied Carona’s motions to arrest judgment and for a judgment of acquittal."

People's Ruling:

So, when will Sheriff Mike been spending his first night in the Slammer?  Not sure.  He still has one very small outside chance for another appeal.. But, I along with many others think his days as a free man are just about done.  You know, our Judicial system needs to be help accountable at all levels.  Crooks are crooks, no mater what type of suits they put on in the morning.  My problem with this case is that Mike Corona portrayed himself as the "Hottest Sheriff in America."  Sorry, dude.  Save it for the Jury.  Opps. You already tried that one.  See you in like 2016'ish?  Hit my comment section.  Sound OFF!

JUDGE ROBERT PERRY THROWS CONVICTIONS IN ANNA NICOLE SMITH DEATH TRAIL OUT THE WINDOW. IS THIS JUSTICE, OR IS THIS THE END OF A TRAGIC STORY IN HOLLYWOOD 'LORE?

Los Angeles, CA

In a stunning turn of events, Los Angeles Superior Court Judge Robert Perry has literally thrown out four of six convictions in the drug trial involving the death of legendary model and realty television show star Anna Nicole Smith.

Incredible that one judge can cast such power in just a blink of the eye.

Perry,  threw out charges against Smith's manager (and companion, and one time "supposed" hubby)  Howard K. Stern, and two of four convictions against Dr. Khristine Eroshevich, a psychiatrist who was Smith's neighbor.

Stern literally won the judicial lottery today with this ruling.

An outraged Los Angeles County District Attorney Steve Cooley just issued a hotly worded statement condemning the ruling.
The jury deliberated more than two weeks and reached a fair and thorough verdict in accordance with the law and the evidence we were allowed to present.  Judge Perry’s ruling today is totally inconsistent with his previous rulings at the preliminary hearing, the trial itself and once again when the defense concluded their case. Each time, he refused to dismiss the conspiracy counts. The evidence has not changed from that time to now," said Cooley.

“His decision denigrates the substantial investigative efforts conducted by the state Department of Justice and the Medical Board. It diminishes the huge social problem of prescription drug abuse facilitated by irresponsible caretakers and unscrupulous medical professionals.  We will immediately pursue all appellate remedies to overturn Judge Perry’s decision. A decision on whether we will seek a retrial on the hung counts will be announced later.”

So, how many millions of dollars from us taxpayers have we spent on this case, already.  Enough is enough.  Time to MOVE on and let Anna Nicole rest in peace.  What are your thoughts?  Is this Justice? Are you tired of this legal drama?  Did the Judge act properly?

ESTEBAN NUNEZ: Here is the ENTIRE COMMUTATION ORDER FROM NOW FORMER (THANK GOODNESS) CALIFORNIA GOVERNOR ARNOLD SCHWARZENEGGER

Sacramento, CA

The outrage over the "commutation" of thug Esteban Nunez by now FORMER CALIFORNIA GOVERNOR ARNOLD SCHWARZENEGGER has caused a media firestorm.  The LA TIMES blasted a huge headline and long summation of the news.

ESTEBAN NUNEZ is a HOT TRENDING TOPIC on GOOGLE this morning.

Every talk radio show up and down the Left Coast is a buzz and so am I. People are mad as hell over this situation, and this is not going to be "swept" under some random carpet anytime soon.

Anyway, I wanted to post the ACTUAL COMMUTATION of ESTEBAN NUNEZ in its entirety.

Amazing how politics and politicians can destroy our Judicial system at the 11th hour of the term from the worst Governor we have had here in California in almost a Century.

.Shame on Arnold, and EVERYONE who had ANYTHING to do with this INJUSTICE!

Keep hitting my comment section.  Sound Off.  Send the word around about this.  Don't sit on your hands.
BTW.  All of these photos come from Esteban Nunez FORMER MY SPACE account that has been now CLOSED.

Commutation of  ESTEBAN NUNEZ,  CASE AE-1200

On October 4, 2008, Esteban Nunez and Ryan Jett fought with Luis Dos Santos and several
others near San Diego State University. During the fight, Jett stabbed Santos to death with a
knife. Nunez did not kill Santos. Both Jett and Nunez entered a plea agreement and were
convicted for voluntary manslaughter and sentenced to the maximum term in State prison.
Santos’s death is tragic, and I do not discount the gravity of the offense. But given Nunez’s
limited role in Santos’s death, and considering that, unlike Jett, Nunez had no criminal record
prior to this offense, I believe Nunez’s sentence is excessive. Accordingly, I commute Nunez’s
sentence to the lower term for the crimes for which he was convicted: seven years in State
prison.

According to the probation report, around the time of the offense, Nunez, Jett, Rafael Garcia,
and Leshanor Thomas drank alcohol and went to a college fraternity party. They were not
admitted to the party, and they left. They drank some more, and they talked about fighting
someone. At some point, Jett saw Santos and Brandon Scheerer on the university campus.
Jett yelled at them and threw up his hands. Led by Jett, they confronted Santos and Scheerer.
Santos and Scheerer ran off in opposite directions. Santos met up with Keith Robertson, Evan
Henderson, and another person named Jason. Santos was panicked, and he said that they
were “about to be jumped by four or five guys.” Santos, Robertson, Henderson, and Jason
walked down a street to find Scheerer. At that time, Jett confronted Santos, and a fight broke
out between the two groups. Both groups had been drinking throughout the evening. The fight
occurred sometime after 2:00 a.m. and lasted between 30 and 45 seconds.

Not surprisingly, there are different versions of the fight. However, the following key facts are
not in dispute: During the fight, Jett stabbed Santos once through the chest, severing his heart.
Robertson and Henderson were also stabbed. According to Nunez’s sentencing brief, Nunez
admitted he stabbed Henderson in the stomach. Scheerer also joined the fight, and Thomas
punched him in the eye.
Jett, Nunez, Garcia, and Thomas left the scene. Thomas drove the group to Sacramento.
Once there, they went to the Sacramento River, burned their clothes, and threw their knives in
the river.
Nunez was 19 years old at the time of the offense, and he had no previous criminal record. He
subsequently pled guilty to voluntary manslaughter with the use of a knife. He also pled guilty to
assaulting Henderson and Robertson with a deadly weapon, and he admitted that he inflicted
great bodily injury on Henderson and Robertson. Nunez was sentenced to an aggregate term
of 16 years in state prison. The court imposed the maximum 11-year sentence for voluntary
manslaughter, plus one year for using a knife. The court also sentenced Nunez to one year for
assaulting Henderson with a deadly weapon, plus one year for inflicting great bodily injury.
Similarly, the court sentenced Nunez to one year for assaulting Robertson with a deadly
weapon, plus one year for inflicting great bodily injury. Having been once convicted of a felony, Nunez applied for a commutation of his sentence on the ground that his sentence is disproportionate in comparison to Jett’s sentence. Like Nunez, Jett also pled guilty to voluntary manslaughter with the use of a knife and two
counts of assault with a deadly weapon, each enhanced for inflicting great bodily injury. And
like Nunez, Jett was sentenced to 16 years in state prison. He too received the maximum 11-
year term for voluntary manslaughter. But at Jett’s sentencing hearing, the court told Jett, “I believe a fair reading of the evidence, including logical inferences from the circumstantial evidence, is that you were the person that actually caused the death of Mr. Dos Santos by inflicting the knife wound to his chest area.”
The court also said that Jett “killed Luis Dos Santos. He severed his heart. He cut through the ribs.” In addition, Jett was identified as occupying a position of leadership in the offense. “I believe,” the court said, “that the best evidence is that you were the person who started the confrontation, if you will, and confronted Mr. Santos.”  On the other hand, the court acknowledged at Nunez’s sentencing hearing that Nunez, “pled to
aiding and abetting” in the death of Santos. He was not the actual killer. But despite the evidence that Jett was a leader and instigator in the offense, and that he stabbed and killed Santos, the court sentenced Nunez to the same maximum prison sentence as Jett. Moreover, Nunez and Jett had very different criminal backgrounds, and this fact deserved greater weight at Nunez’s sentencing. This offense was Nunez’s first, and he had no prior criminal record. In contrast, the court told Jett at his sentencing hearing, “Your convictions as
an adult are numerous and in increasing seriousness.” The court also noted that Jett was on probation at the time of the offense, and that he had been given chances on probation and to rehabilitate himself. But, the court indicated, his performance, “quite frankly, is a dismal failure.”  Considering Nunez’s limited role in the killing and his clean prior criminal record, I believe his sentence is disproportionate in comparison to Jett’s. The lower terms for voluntary manslaughter (three years) and assault with a deadly weapon (two years each) would be more appropriate in light of these differences.

NOW, THEREFORE, I, ARNOLD SCHWARZENEGGER, Governor of the State of California, in
accordance with the authority vested in me by the Constitution and statutes of the State of
California, hereby commute Esteban Nunez’s 16-year sentence to seven years in State prison.

IN WITNESS WHEREOF, I have hereunto set my hand and caused the Great Seal of the State
of California to be affixed this 31st day of December, 2010.

San Diego, CA

Shame on you Arnold Schwarzenegger.  Tonight you have GONE way TOO FAR, pal!

With just hours left before he is OUT as Governor of California, Arnie boy has play his last game of political poker against the people of California.

Fabian NunezImage by Freedom To Marry via FlickrYep.  The Guvenator has pulled a fast one and has help out his old political pal Speaker Fabian Nunez' one last time.  Tonight, I am just as outraged as millions of other Californians to hear the news that he has commuted the prison sentence of Fabian Nunez, the son of the  former head of the State Assembly who had pleaded guilty to taking part in the murder of a college student at a San Diego university Frat Party.

As you recall, and as I have been blogging about since the night of this horrific crime that Nunez participated and shocking just about every Californian, Fabian Nunez was given a 16 year prison sentence for his role in the October 2008 stabbing death of college student Luis Dos Santos near San Diego State University.

He should have gotten life in prison.  Period.

In a statement, released to members of the media on Sunday night,  Governor Schwarzenegger said that that Nuñez, "while involved in the fight, did not inflict the fatal knife wound to Santos' chest."

WTH?  Are you kidding me?

Swarz cited a finding by the court that it was a friend of Nuñez who stabbed Santos through the chest, "severing his heart. ""I do not discount the gravity of the offense," Schwarzenegger's statement said. "But given Nuñez's limited role in Santos' death, and considering that…Nuñez had no criminal record prior to this offense, I believe Nuñez's sentence is excessive."

Fabian Nuñez is now a business partner of the governor's chief political advisor at the consulting firm Mercury Public Affairs, according to the LA Times.  Politics and seedy political payoffs.  We have a new low "standard of justice" here in California.

Remember, boyz and girlz....it's not the crime you commit, and the lives you take here in California, or the vicious attack that took the life of an innocent man.  In California, all you need is a "get out of Jail Pass" early from a seed bag like Arnold and Company and you can get away with anything.

So, in less than 12 hours, Jerry Brown is going to be the next Governor of California. What a disgrace Arnold turned out to be.  Such a political fool.  So, don't let the door hit you on the way down the 5 Freeway tomorrow, pal.
Laughing All the WAY....Arnold, you did it again!

Pitt vs. ToledoImage by esherman via FlickrI wanted to update the news on recently hired University of Pittsburgh Football Coach Mike Haywood, who was arrested on New Years Eve morning on domestic violence charges while visiting his girlfriend and her son in South Bend, Indiana.

Haywood has been TOSSED OUT ON HIS BEHIND and has been fired by Pitt Chancellor Mark Nordenberg.

The statement for Nordenberg reads as follows:

"After careful consideration of recent events, the University of Pittsburgh has dismissed Michael Haywood as its head football coach, effective immediately. He was advised of that action this afternoon.

“To be clear, the University’s decision is not tied to any expectation with respect to the terms on which the legal proceeding now pending in Indiana might ultimately be concluded. Instead, it reflects a strong belief that moving forward with Mr. Haywood as our head coach is not possible under the existing circumstances “This is a matter of real regret for the many people at Pitt who had looked forward to working with him. However, head coaches are among the University’s most visible representatives and are expected to maintain high standards of personal conduct and to avoid situations that might reflect negatively on the University. “We will immediately re-open our search for a head football coach, expanding the process to include a larger pool of candidates. Our goal is to move swiftly, but prudently, to find the right person to successfully lead the Pitt football program for what we hope will be an extended period of time.”

All I can add is, Amen.  We don't need people like Mike Haywood coaching in College Football, or High School Football, or Pro Football.  Every man is considered "innocent" untill proven guility.  I stand by the American Justicial System.   Thank you Chancellor Nordenberg for taking a stand against domestic violence.

I am off to Sportsmart to pick me up a Pitt Jersey.  NOW this is a UNIVERSITY WORTH SUPPORTING!  Go PANTHERS!

Holy smoke.  WHAT a ROSE BOWL!

This morning the Rose Parade started with a flyover by the Stealth Boomer.  Tonight it was a Tank that flattened the Wisconsin Badgers.

Just wanted to give a huge shout out to the Texas Christian University Horned Frogs for beating the Wisconsin Badgers 21-19 in one of the GREATEST ROSE BOWL games ever played.

The play of the new decade so far goes to Tank Carder, the Defensive back who literally saved the day for TCU. After a Wisconsin touchdown late in the game, and while going for a two point conversion that would have sent the game into OVERTIME,  Carder slapped a Scott Tolzien's pass, intended for tight end Jacob Pedersen and sealed the deal for the Horned Frogs.

Tank was the Defensive Player of the Game.  I say, Tank, stay in Pasadena.  Run for Mayor.  This TOWN belongs to you pal! Grab me my phone.  Gotta call Tank! What a game!  One for the ages.  What did you think?  Amazing, or what? Hit my comment section.

Dozens more were arrested on suspicion of possessing the psychedelic drug.  Sad thing is, that you and I are once again are picking up the tab for the costs to protect and treat these out of control party goers. One man trying to exit the venue took ``a long fall'' on the Figueroa Street side of the arena, firefighters said, adding that he was among those hospitalized early today.   It is estimated than more than 26,000 people attended the event.  Way over capacity for this old worn out arena.
Firefighter-paramedics and police were especially busy between midnight and 2 a.m. at the 13th annual ``Together As One'' event, billed by promoters as ``the world's largest New Year's Eve dance music festival.''

In the 90 minutes before the event was scheduled to end at 2 a.m., paramedics treated multiple patients -- including two young men and a young woman believed to be in her late teens -- for possible drug overdoses.  Glad that we aren't having to plan a bunch of funerals this beautiful New Years morning because of events like this one...  WAKE up LA COUNTY BOARD OF SUPERVISORS!  STOP THESE TAXPAYER SUPPORTED RAVES ONCE AND FOR ALL! STOP PUTTING PERSONAL PROFITS BEFORE THE SAFETY OF OUR RESIDENTS.  IS IT TIME TO FOLLOW THE MONEY?   I KNOW WHERE THE TRAIL STARTS AND ENDS.  ENOUGH in ENOUGH.   Click here for an AMAZING look at the MONEY TRAIL from the RAVE promoters.  It will SHOCK you.  Thanks to LA WEEKLY for this REMARKABLE INSIDE LOOK!

The 2011  Rose Parade is over. Finally. I have been glued to KTLA Channel 5 all morning long, and I have some winners, lots of losers, and well, I hope the 2012 Rose Parade isn't a snooze fest like today's edition.

First Award goes to KTLA CHANNEL 5 NEWS!
AMAZING COVERAGE!
SCALE OF 1 to 10:    THEY GET A 10 PLUS!

Stephanie Edward and Bob Eubanks and Micha Olhman were delightful.  Enjoyed seeing all the great students from Cal Poly sitting in the crowd and serving as "Commentators" for Micha.  Great JOB, KTLA!  The Morning News Team on KTLA also did an amazing job.  What a great group of professionals! Watch KTLA all day long for Rose Parade repeats. Henry DeCarlo rocked, and so did the rest of the Morning News Team.  SIMPLY THE BEST!  The BEST LINE of the MORNING was the "NUTS ON MY FACE" comments from Stephanie Edwards. Watch this clip that is beginning to go "viral" on You Tube.  Some are calling for a "changing of the guard" on the live Parade Coverage with KTLA for 2011.  I tend to agree. Turn the 2011 Rose Parade on KTLA over to the MORNING NEWS TEAM as the new "Bob" and "Stephanie." But overall, a TREMENDOUS JOB!

MARCHING BANDS WERE THE BEST in the past decade.  The High School bands were incredible.  My favorite was the band from Japan.  Yep. The North Japan Honor Green Band was full of energy, and full of life.  Also loved these High School bands: Banda Musical Delfines Band, Southwest De Kalb High School Band, the All-Birdville High School Band.  Also loved the West Coast Composite Marine Marching Band.  Above is the University of Wisconsin Marching Band. BTW. Most of the FLAG TWIRLERS need to go on diets. Just sayin'

EQUESTRIANS get a HUGE 10 out of 10!

Prue magic to see the best horses in the world to march down Colorado Boulevard.  This was the HIGHEST point of this years parade.  KUDOS to Marine Corps Mounted Color Guard, The Scripps Miramar Saddlebreds.

THE FLOATS GET A TOTAL SCORE of 6 OUT OF 10

Sorry, the Floats this year were a total bomb. This years theme "Building Dreams" was a total dud.  It did not hit the nail on the head.

Way too many floats with "houses" and "huts" plopped on them.  Looked like watching houses of trailers. Most of the Floats all looked alike. Very little creativity this year, with the exception of the Reagan Library Float, the Pac Man Float, The Cal Poly University Float.  The City of Sierra Madre had a breakdown at the beginning of the Parade, that literally threw the entire parade under "a bus" so to speak.  The City of Los Angeles Float was just plain silly.  Still can't figure out why Dole Foods got the Sweepstakes, other than the fact that it was a first time entry.

THEME OF THE PARADE "BUILDING DREAMS, FRIENDSHIPS, AND MEMORIES" gets a 4 out of 10.

Trust me, this Parade will be forgotten about by January 3rd.What were they thinkin?

TOURNAMENT WEBSITE was also down most of the morning.  No excuses for this "breakdown" in technology.

DRUNKS IN THE CROWD
9 out of 10
Pasadena Police arrested 48 people for being drunk in public from midnight and by the end of the Parade.  Wait till tonight.  Wild Rose Bowl starts in an hour!
