In a stunning turn of events, Los Angeles Superior Court Judge Robert Perry has literally thrown out four of six convictions in the drug trial involving the death of legendary model and realty television show star Anna Nicole Smith.
Incredible that one judge can cast such power in just a blink of the eye.
Perry, threw out charges against Smith's manager (and companion, and one time "supposed" hubby) Howard K. Stern, and two of four convictions against Dr. Khristine Eroshevich, a psychiatrist who was Smith's neighbor.
Stern literally won the judicial lottery today with this ruling.
An outraged Los Angeles County District Attorney Steve Cooley just issued a hotly worded statement condemning the ruling.
“The jury deliberated more than two weeks and reached a fair and thorough verdict in accordance with the law and the evidence we were allowed to present. Judge Perry’s ruling today is totally inconsistent with his previous rulings at the preliminary hearing, the trial itself and once again when the defense concluded their case. Each time, he refused to dismiss the conspiracy counts. The evidence has not changed from that time to now," said Cooley.
“His decision denigrates the substantial investigative efforts conducted by the state Department of Justice and the Medical Board. It diminishes the huge social problem of prescription drug abuse facilitated by irresponsible caretakers and unscrupulous medical professionals. We will immediately pursue all appellate remedies to overturn Judge Perry’s decision. A decision on whether we will seek a retrial on the hung counts will be announced later.”
So, how many millions of dollars from us taxpayers have we spent on this case, already. Enough is enough. Time to MOVE on and let Anna Nicole rest in peace. What are your thoughts? Is this Justice? Are you tired of this legal drama? Did the Judge act properly?
