FBI Badge & gun.Image via WikipediaLOS ANGELES—The former director of construction for Huntington Memorial Hospital was arrested this morning on federal mail fraud arising from his role in a construction kickback scheme that allegedly brought him more than $3 million in illegal payments.

David Hamedany, 54, of Glendale, was arrested at his residence without incident by special agents with the Federal Bureau of Investigation.

Hamedany was the director of construction for Huntington Memorial Hospital from 2006 until June 2010, during which time he had authority to enter into contracts and approve various invoices for the hospital. According to the indictment returned yesterday by a federal grand jury, Hamedany authorized payments of more than $3.8 million to construction companies that later made kickback payments of more than $3 million to entities controlled by Hamedany and/or a relative of Hamedany.

The indictment specifically alleges that three Northern California companies received most of the money involved in the fraudulent contracts, collectively receiving more than $3 million from the hospital. The payments were pursuant to invoices approved by Hamedany, even though the three companies performed no construction work for the hospital. These three companies allegedly paid kickbacks of more than $2.5 million to entities controlled by Hamedany and/or a relative of Hamedany.

An indictment contains allegations that a defendant has committed a crime. Every defendant is presumed to be innocent until and unless proven guilty in court.

The indictment in this case charges Hamendany with 12 counts of mail fraud. Each count of mail fraud carries a maximum statutory penalty of 20 years in federal prison.

Hamendany is expected to be arraigned this afternoon in United States District Court.
On January 11, FBI agents seized approximately $480,000 from a bank account into which Hamendany transferred approximately $585,000.

This case is the result of an investigation by the Federal Bureau of Investigation. Huntington Memorial Hospital has fully cooperated in the investigation.

David already settled on this. The trial date will be for any remaining parties that the insurance company is trying to get money from and have not already settled with.

Sentencing date for Tony "The Thief" is now Nov. 13th. Final settlement in civil case Oct. 3rd which is probably reason for delay.

Good for Abe, I'm sure he had no idea what the Hamedany boys were actually getting him into, and I'm sure the stress of all this has taken it's toll emotionally and financially. Alex Svidler being sentenced mon 10/29 8:30am in Federal Court. So long to another big ass cheater!

Did she abort the baby and tell him that she "lost" it? Funny how the player got played too! Is he going to divorce that green card wanting and gold digger?

Haw has been indicted by the Feds as well, yeah!!!!!!!!
Pleaded not guilty of course and trial is set for Dec. 18th.
But just like the rest I'm sure his plea will change prior to trial once he bargains for less time in jail.
To hell you go all you friggin' thieves!!!!!!!

Oh yeah he's gonna do as much time as his scumbag brother. Delayed yet again untol Dec. because of Haw's indictment. Still sitting around drinking himsef into oblivion while visiting the bro in the slammer. When sober calling the fam in Iran to make sure the money there is safe and sound because.....there is nowhere for them to go once out of jail since they will be on three year probation. Who the hell would ever hire these fools into a high powered position again? Soo they will wait it out and high tail it back there to retire in what they concider luxory I'm sure. Once again putting on their airs of superiority and wealth. But really what they have is nothing since all respect is gone.

A former construction manager overseeing expansion of Huntington Memorial Hospital’s emergency department pleaded guilty Wednesday in federal court to participating in an illegal kickback scheme designed to bilk the hospital out of pay for unnecessary work.

John Haw, 52, faces a sentence of between one and 40 years in prison for two counts of mail fraud, according to a statement by U.S. Attorney’s Office.

Haw, an Aliso Viejo resident, and two other men have been convicted of kickback schemes involving former Huntington construction director David Hamedany.

Hamedany was sentenced in January to three years in federal prison and was ordered to pay $4.8 million in restitution to the hospital.

Haw paid more than $56,000 to a company owned by Hamedany after Hamedany agreed to provide Haw with more billable hours for legal and consulting services, according to Haw’s plea agreement.

Huntington paid Haw nearly $350,000 between March 2008 and April 2009 at fees of up to $275 per hour.

Alexander Svidler, a San Francisco construction executive, was sentenced last month to 18 months in federal prison for two counts of mail fraud involving a separate scheme with Hamedany.

Svidler billed Huntington for $2.3 million in phony construction work authorized by Hamedany between 2007 and 2010. Svidler kept 10% of the money and funneled remaining profits to Hamedany, according to federal prosecutors.

Tony Hamedany, brother of David Hamedany, will be sentenced in January for a similar kickback scheme in Northern California that involved payoffs to some of the same accounts used to defraud Huntington, said Assistant U.S. Atty. Angela Davis.

Haw will be sentenced on Feb. 4 by U.S. District Court Judge Percy Anderson in Los Angeles. Anderson also handled sentencing of Hamedany and Svidler.

In addition to a prison sentence, Haw may also be ordered to pay restitution to the hospital, said Davis.

Huntington’s expansion effort is expected to increase the size of the hospital waiting area, more than double the capacity of the emergency room and lead to other improvements. The work is slated for completion in early 2015, according to the hospital’s website. The project’s more than $80-million budget is being funded by donations to the hospital.

Hospital officials have filed a series of civil lawsuits seeking damages for construction fraud, said Davis.

A Bay Area contractor who played a key role in defrauding Huntington Memorial Hospital of $2.3 million was sentenced to 18 months in a federal prison on Monday, according to the U.S. Attorney’s Office in Los Angeles.

Alexander Svidler, 54, who owns a Burlingame construction firm, pleaded guilty in January to two counts of mail fraud. In a deal with then-Huntington construction director David Hamedany, Svidler submitted numerous false invoices and billing statements related to Huntington’s renovation and expansion. Svidler kept 10% of the gains and returned the remaining 90% to Hamedany.

Huntington ended up paying $2.3 million for work on that was never completed.

Svidler also had a deal with Hamedany’s brother, Tony Hamedany, to bilk the owners of Columbus Manufacturing in the Bay Area, according to prosecutors.

In January, David Hamedany was sentenced to three years in prison and was ordered to pay restitution of $4.8 million. Tony Hamedany pleaded guilty to fraud related to the Bay Area work in October 2011 and is slated to be sentenced next month.

The amount of restitution Svidler must pay has not been determined by the court. But he has already returned some $850,000 to Huntington Memorial Hospital and $500,000 to Columbus Manufacturing, according to prosecutors.

Someone from JCS is at it again. It's the same exact scam, just different victims. Can you post how JCS was involved or is there some way you can email me? You wont believe what I have to add to this. I just cant put all the info here because i am living in fear of them finding me and my family.

A Glendale man who pleaded guilty in a scheme that led to his San Francisco employer suffering losses of more than $2 million—a plot that has connections to a kickback scheme that defrauded Huntington Hospital in Pasadena—has been sentenced to 20 months in federal prison.

Tony Hamedany, 58, who formerly resided in Hillsborough, California, was sentenced yesterday by United States District Judge Percy Anderson, who also ordered the defendant to pay $1.54 million in restitution to his former employer, Columbus Manufacturing Inc., the San Francisco-based manufacturer of salame and other deli products.

Tony Hamedany pleaded guilty in October 2011 to two counts of mail fraud in relation to a kickback scheme he orchestrated during his tenure as director of engineering for Columbus. Tony Hamedany’s position at Columbus enabled him to negotiate construction contracts that he agreed to award in exchange for kickback payments from vendors. The construction contracts—for construction projects related to the salame company’s production facilities in South San Francisco—were adjusted so that vendors would pay Tony Hamedany kickbacks from payments they received from the contracts with Columbus.

Among the people who paid kickbacks to Tony Hamedany was Alexander Svidler, 55, of San Francisco, who pleaded guilty to mail fraud stemming from his participation in the kickback schemes pertaining to both Huntington Hospital and Columbus and was sentenced to 18 months in federal prison.

Tony Hamedany is the brother of David Hamedany, 56, also of Glendale, who is serving a three-year prison term for executing a $4.8 million kickback and fictitious billing scheme during his tenure as director of construction for Huntington Memorial Hospital. The Hamedany brothers ran separate, but parallel, kickback schemes and commingled proceeds in bank accounts in the names of entities formed by the brothers. In addition to the Hamedany brothers and Svidler, an attorney has pleaded guilty pursuant to this investigation. John Haw, 52, of Aliso Viejo, pleaded guilty to two counts of mail fraud in relation to the Huntington Hospital kickback scheme in which Haw received business in exchange for kicking back money to an entity set up by the Hamedany brothers. Haw is scheduled to be sentenced by Judge Anderson on May 6.

Attorney John S. Haw of Aliso Viejo was sentenced Monday to a year of confinement--to be split between a halfway house and home detention--for his role in an illegal kickback scheme involving construction work at Huntington Memorial Hospital in Pasadena.

The 52-year-old pleaded guilty in federal court in November to a pair of mail fraud counts.

Haw performed legal and consulting services while the hospital was completing a construction project involving the expansion of its emergency department, work that paid him as much as $275 per hour, according to the U.S. Attorney's office, which tracked billings of nearly $350,000 from March 2008 through April 2009.

During the same period, Haw paid David Hamedany, Huntington's then-director of construction, kickbacks totaling $56,000 to continue to receive legal work from the hospital. Hamedany was sentenced in January 2012 to three years in federal prison and ordered to pay $4.8 million in restitution.

The government also won convictions for a parallel kickback scheme run by David's brother, Tony Hamedany, in San Francisco. Alexander Svidler, a San Francisco-based construction executive who pleaded guilty to mail fraud in the case, was sentenced last October to a year and a half in prison.

The Hamedany's co-mingled the proceeds from their kickback schemes in accounts both had access to, according to prosecutors.
