VAN NUYS – The Los Angeles County District Attorney’s office filed multiple murder, mayhem and other felony charges today against a 26-year-old man accused of killing four people at a North Hollywood eatery earlier this month.

Deputy District Attorney Beth Silverman of the Major Crimes Division filed case No. LA064891 in Van Nuys Superior Court as a felony complaint for arrest warrant against Nerses Arthur Galstyan (dob 12-18-1983), who was arrested two days ago near Seattle, Wash. Extradition proceedings are pending.

Galstyan was charged with four counts of first-degree murder with the special circumstance of multiple murders. Although filed as a potential capital case, the District Attorney’s office will not decide whether to seek the death penalty until the case moves closer to trial.

The complaint also charged one count of mayhem involving one of the victims who survived the attack as well as two counts of attempted first-degree murder. The complaint alleged that Galstyan used a handgun to commit the crimes.

Galstyan was arrested at a home in Kenmore, Wash., on Tuesday, according to news accounts from Washington state following an announcement by the U.S. Marshals Service there. Also arrested was his 24-year-old brother, Samuel, who was later released but remains under investigation, authorities said.

Silverman said there was insufficient evidence to file charges on the younger brother at this time. Nerses Galstyan is being held without bail.

The shooting occurred on April 3 at the Hot Spot Mediterranean Restaurant on Riverside Drive in North Hollywood. Killed when the gunman opened fire were Hayk Yegnanyan, 25; Vardan Tofalyan, 31; Sarkis Karadjian, 26: and Harut Baburyan, 28.
